By downloading, installing, accessing, or using ForkYes!ForkNo! (the "App"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms and conditions that may apply to specific features of the App. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ForkYes!ForkNo! ("we," "us," or "our").
If you are accessing or using the App on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, and references to "you" shall refer to that entity.
If you do not agree to these Terms in their entirety, you must immediately cease all use of the App and uninstall it from your devices. We reserve the right to update these Terms at any time, and your continued use of the App constitutes your acceptance of any such changes.
ForkYes!ForkNo! is a mobile application that allows users to log, track, rate, and share their restaurant dish experiences. The App is available in two tiers:
We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App or any part thereof.
You must be at least 13 years of age to use this App. If you are between 13 and 18 years of age, you must have the permission of a parent or legal guardian to use the App and to make any in-app purchases. By using the App, you represent and warrant that you meet these age requirements.
The App is intended for use in jurisdictions where it is lawful to do so. You are responsible for ensuring that your use of the App complies with all laws and regulations applicable in your jurisdiction. We make no representation that the App is appropriate or available for use in all locations.
To access certain features of the App, you must create an account using Google Sign-In, Apple Sign-In, or an email address and password. By creating an account, you agree to:
We reserve the right to disable your account at any time if, in our opinion, you have violated any provision of these Terms. You may not create more than one account per person. Accounts are non-transferable.
If you use a third-party sign-in service (Google or Apple), your use of that service is governed by their respective terms of service and privacy policies, which are separate from these Terms.
Fork Yeah! Premium is available as a monthly or annual auto-renewing subscription. Current pricing is displayed in the App at the time of purchase and may vary by country or region based on local pricing set by the applicable app store.
By subscribing, you authorize us (through the applicable app store platform) to charge the payment method associated with your app store account for the applicable subscription fee at the beginning of each billing period.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription at any time through your Google Play or Apple App Store account settings. Cancellation takes effect at the end of the current billing period — you will continue to have access to premium features until that date.
All purchases made through the Apple App Store are subject to Apple's Terms of Service. All purchases made through Google Play are subject to Google Play's Terms of Service. We do not control the payment process and are not responsible for payment disputes handled by these platforms.
We may offer free trials of Fork Yeah! Premium from time to time. Free trial eligibility is determined at our sole discretion. If you do not cancel before the end of a free trial period, you will be automatically charged for the applicable subscription.
We reserve the right to change subscription pricing at any time. Price changes will take effect at the start of the next billing period following the date of the price change. We will provide reasonable advance notice of any price change through the App or by email.
Refunds are handled according to the policies of the platform through which you purchased the subscription (Google Play or Apple App Store). We do not process refunds directly. Please contact the applicable platform's support to request a refund.
The App allows you to submit, upload, and store content including dish entries, restaurant names, verdicts, notes, and photos ("User Content"). You retain all ownership rights in your User Content.
By submitting User Content to the App, you grant ForkYes!ForkNo! a worldwide, non-exclusive, royalty-free, sublicensable license to store, reproduce, display, and process your User Content solely to the extent necessary to operate and provide the App to you and the users you choose to share with. This license terminates when you delete your content or account.

We use automated moderation (Google Cloud Vision API) to review photos uploaded to the App. Content that violates these Terms may be removed without prior notice. We reserve the right, but are not obligated, to review any User Content and to remove or disable access to any User Content that we determine, in our sole discretion, violates these Terms.
The App and all of its original content (excluding User Content), features, and functionality are and will remain the exclusive property of ForkYes!ForkNo! and its licensors. The App is protected by copyright, trademark, and other intellectual property laws.
Our trademarks and trade dress, including the name "ForkYes!ForkNo!," "Fork Yeah!," and associated logos, may not be used in connection with any product or service without our prior written consent.
Nothing in these Terms grants you any right, title, or interest in the App or any of our intellectual property, except the limited license to use the App as set forth herein.
We respect the intellectual property rights of others and ask users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through the App, please notify us at legal@forkyesforkno.com with the following information:
We will respond to valid DMCA notices and take appropriate action, which may include removing or disabling access to the allegedly infringing content.
You agree to use the App only for lawful purposes and in a manner consistent with these Terms. You agree not to:
Fork Yeah! Premium users may create and join sharing groups to share dish entries with selected individuals ("Group Members"). By creating or joining a group, you acknowledge and agree that:
You agree not to use sharing groups to harass, intimidate, or harm any individual. We reserve the right to disband any group that we determine, in our sole discretion, is being used in violation of these Terms.
The App integrates with and relies upon various third-party services, including but not limited to Google Firebase, Google Places API, Google Cloud Vision API, RevenueCat, Apple Sign-In, Google Sign-In, and Microsoft Office 365. Your use of such third-party services is subject to their respective terms of service and privacy policies.
We are not responsible for the availability, accuracy, content, or practices of any third-party services. Links or integrations with third-party services do not constitute an endorsement by us of those services.
We reserve the right to modify, replace, or discontinue integrations with any third-party service at any time without notice.
If you submit ideas, suggestions, or feedback about the App ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such Feedback for any purpose without compensation or attribution to you. You waive any moral rights you may have in such Feedback to the fullest extent permitted by law.
We may from time to time offer access to beta features or pre-release functionality ("Beta Features"). Beta Features are provided "as is" and may be modified or discontinued at any time without notice. Beta Features may contain bugs or errors and are not subject to any service level commitments. Your use of Beta Features is entirely at your own risk.
By creating an account, you consent to receive electronic communications from us, including a welcome email sent to the address you provided at registration. You may opt out of non-essential communications at any time by contacting us at support@forkyesforkno.com. Transactional communications related to your account or subscription may not be opted out of while your account remains active.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FORKYES!FORKNO!, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, THE COST OF SUBSTITUTE SERVICES, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless ForkYes!ForkNo! and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in the State of Hawaii.
Before initiating arbitration, you agree to first contact us at legal@forkyesforkno.com and attempt to resolve the dispute informally. If we are unable to resolve the dispute within 30 days, either party may commence arbitration.
The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND FORKYES!FORKNO! EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. You acknowledge that the internet is not a completely secure medium and that we cannot guarantee the security of any information transmitted through the App.
We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause and with or without notice, including for violation of these Terms, conduct that we determine is harmful to other users or to us, or for any other reason at our sole discretion.
You may delete your account at any time through the App settings. Upon account deletion, all of your data will be permanently deleted. This action cannot be undone.
Upon any termination of your account:
All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, internet or telecommunications failures, power outages, or actions of third-party service providers.
The App may be subject to United States export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce. You represent that you are not located in a country that is subject to a U.S. government embargo and that you are not listed on any U.S. government list of prohibited or restricted parties.
If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable, consistent with the parties' original intent.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of ForkYes!ForkNo!. No waiver of any breach or default of these Terms shall constitute a waiver of any subsequent breach or default.
You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice to you, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets. These Terms will bind and inure to the benefit of each party's permitted successors and assigns.
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire and exclusive understanding and agreement between you and ForkYes!ForkNo! regarding the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the App.
We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice through the App, by email, or by updating the "Last Updated" date at the top of this page. Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
These Terms and any dispute arising out of or related to them or the App shall be governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to its conflict of law principles. To the extent that any lawsuit or court proceeding is permitted hereunder, you and ForkYes!ForkNo! agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Hawaii.
